It’s the Law: What You Should Know About the Rights of Nursing Home Residents

By Justice For Our Parents

Patient Rights

Whether your loved one lives in a nursing home short- or long-term, federal and California state law protects them. These rights are not optional—they are legal guarantees.

Key Resident Rights Include:

  • The right to be treated with dignity and respect
  • The right to freedom from abuse and neglect
  • The right to participate in their own care decisions
  • The right to privacy and confidentiality
  • The right to file complaints without fear of retaliation
  • The right to have visitors and communicate freely
  • The right to manage their own money or choose someone to do it

In California, these protections are reinforced by the California Health and Safety Code §1599.1 and the federal Nursing Home Reform Act (OBRA 1987).
