VETERANS HOME OF CALIFORNIA — BARSTOW — CDPH INVESTIGATION REVEALS THE FACILITY WAS FAILING TO SERVE DIABETIC MEALS TO ITS DIABETIC PATIENTS AS ORDERED BY THEIR DOCTORS

A therapeutic diet is a diet prescribed to a patient to meet the nutritional needs of that patient. For example, heart patients are often prescribed a low sodium diet and elderly patients are often prescribed a diet high in protein (helpful for many things including healing from wounds). Therapeutic diets are particularly important for diabetic patients to help stabilize their blood-sugar levels. An investigation conducted by the CDPH revealed that, in violation of Title 42, Veterans Home of California-Barstow (an SNF operated by the Department of Veterans Affairs) was not serving therapeutic diets to diabetic patients as ordered by their doctors; instead, the patients were being given deserts high in sugar. About the Facility: Veteran’s Home of California — Barstow is a 60-bed nursing home (skilled nursing facility aka SNF) located at 100 Veterans Parkway, Barstow, CA 92311. It also has 120 Intermediate Care beds. The facility is owned by the Department of Veteran’s Affairs (an agency of the federal government) which operates a number of veterans’ nursing homes in California.

Medicare’s Overall Quality Rating: Medicare’s overall quality rating of Veterans Home of California – Barstow has an overall Medicare rating of five (5) stars (out of a possible 5 stars) which is a MUCH ABOVE AVERAGE rating.

Staff-to-Patient Ratios: As calculated by the Long Term Care Community Coalition (LTCCC) in 2017, Veterans Home of California-Barstow provides an average nursing-to-patient staffing ratio of 4.3 which is well above California’s legally required minimum of 3.2 nursing hours per patient, per day, on average.

CDPH Records: Investigative surveys conducted by the CDPH resulted in Veterans Home of California being issued a STATEMENT OF DEFICIENCY which included violations of the following Title 42 laws/regulations:

Title 42 § 483.10(f)(2): Pursuant to 483.10(f)(2), nursing home residents have a right to have the facility make prompt efforts to resolve their grievances. In violation of Title 22, the Veterans Home of California failed to document that concerns raised by the Resident Council at Veterans Home of California were addressed. The investigator determined the violation had the potential of interfering with the continuity of care for facility residents.

Title 42 § 483.13(c)(1)-(4): Title 42 prohibits nursing homes (aka SNFs) from employing persons who have been found guilty of abusing, neglecting or mistreating residents. Additionally, nursing homes personnel are required to report all alleged incidents that involve mistreatment, neglect or abuse. Moreover the nursing home must have evidence that such incidents were thoroughly investigated. In violation of Title 42, Veterans Home of California failed to report an allegation of physical abuse to the CDPH within the timeframe mandated by law.

Title 42 § 483.35(e): Section 483.35(e) of Title 42 requires nursing homes (aka SNFs) provide its residents with the therapeutic diets prescribed by the patients’ attending physician(s). In violation of § 483.35(e), a CDPH investigator determined that multiple residents whose doctors had placed on a diabetic diet were being fed a regular diet. This failure was found to have the potential of the patients experiencing elevated sugar levels as well as medical complications.
